The final rules issued by the U.S. Treasury and IRS include significant changes and flexibilities to drive deployment while adhering to the law’s emissions requirements.12 While the final rules maintained the three pillars of clean energy sourcing—incrementality, temporal matching, and deliverability 12—they clarified how hydrogen producers can determine eligibility. The final rules notably offer an hourly accounting option for electricity-related emissions, helping producers avoid losing credit value if they cannot procure energy attribute certificates (EACs) for limited hours.12 This clarity provides investment certainty and is viewed by the Treasury as a way to “power heavy industry and help create good-paying jobs”.12
